Labour-Only Sub-Contractor (LOSC)
A Labour-only subcontractor usually works under your direction, use your materials, is paid regularly, and do not have their own Public Liability insurance. In terms of insurance a LOSC counts as one of your employees, unless they are a trainee.
A worker is likely an LOSC if they:

  • Are paid daily, weekly, or monthly
  • Work under your instruction
  • Use materials you provide
  • Do the work themselves
  • Can work overtime

On-Site Supervisors
On-Site Supervisors are counted as manual workers and should be included when selecting the number of employees.

Clerical Staff
Clerical staff are usually office-based people who don’t do any manual labour.

Employees: Trainees: Clerical / admin staff:

A Bona fide subcontractor is an independent contractor who works under your direction, but supplies their own materials and has their own Public liability insurance. They are generally not classed as employees in insurance purposes.
A worker is likely bona fide if they:

  • Agreed a fixed price for the job
  • Pay for their own materials
  • Have their own Public Liability insurance
  • Can hire others to do the work
  • Decide how, when, and where the work is done

Do you employ Bona Fide sub contractors?

In order to help those who have suffered injury or disease in the workplace identify the relevant Employers' Liability insurer quickly and efficiently, it is now a regulatory requirement for all insurers to supply a unique identifier to the Employers' Liability Tracing Office for their database. If you are purchasing Employers' Liability cover, and operate a Pay As You Earn (PAYE) scheme, please supply your Employee Reference Number (Payroll Number) below.

If you do not have this available at the moment, then please proceed to purchase cover, and one of our representatives will contact you shortly to obtain this.
